Hybrid Athlete — Terms of Service

Hostable as-is alongside the privacy policy. Same caveats apply — review with an Irish solicitor before scaling past a few hundred users or if you incorporate. Until you incorporate, the operator is Can Ayan (sole trader) based in Ireland.
These Terms govern your use of the Hybrid Athlete iOS app and the optional AI Coach proxy service (together, the "Service"). By creating an account, completing onboarding, or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service — what it is, what it is not
Hybrid Athlete generates personalised training plans by combining your stated sports, goals, equipment, and training history with a rule-based planning engine. The optional AI Coach feature surfaces an on-device or live-model-backed read of your plan and answers questions about your training.
The Service is for informational and educational purposes only.
The Service is not:
- A substitute for medical, physiotherapy, or qualified strength &
conditioning advice.
- Medical diagnosis, treatment, prescription, or rehabilitation.
- Personal supervision by a real coach.
- A medical device under the EU Medical Device Regulation (MDR) or any
comparable framework.
If you have any medical condition (including but not limited to heart disease, high blood pressure, joint problems, recent surgery, pregnancy, or recovery from injury), you must consult a qualified healthcare professional before starting any exercise programme, including those generated by Hybrid Athlete.
2. Assumption of risk
Exercise carries inherent risk of injury, including serious injury and, in rare cases, death. By using the Service you acknowledge and voluntarily assume all risks associated with the exercises, intensities, loads, and progressions you choose to perform, whether or not the Service suggested them.
You are responsible for:
- Determining whether any given workout, exercise, intensity, or load
is appropriate for you on the day you train it.
- Stopping immediately if you experience pain, dizziness, lightheaded
ness, abnormal breathing, chest discomfort, or any sensation that is unusual or alarming.
- Seeking immediate medical attention for any injury or condition that
may have arisen during or after using the Service.
- Using equipment safely and within manufacturer guidelines.
- Training in an appropriate environment with appropriate supervision
for your skill level.
The plans surfaced by the Service include conservative scaling notes, warm-ups, and intensity guidance to reduce risk, but they cannot substitute for your own judgement, your physician's advice, or in-person supervision.
3. Age requirement
You must be at least 18 years old to use the Service. The Service is not directed at minors and we do not knowingly accept users under 18. For data-protection purposes the Irish digital age of consent (16 years, per §31 Data Protection Act 2018) is the floor below which we will not knowingly process personal data — see our Privacy Policy §10.
4. Account, accuracy of information, and your responsibilities
You agree to:
- Provide accurate onboarding answers (sports, goals, equipment,
limitations). Inaccurate information may lead the engine to produce inappropriate sessions.
- Disclose any limitations or injuries in the relevant fields. The
Service uses these to filter exercises, but the filtering is best-effort and depends on the accuracy and completeness of what you enter.
- Keep your sign-in credential confidential.
- Not use the Service for any unlawful purpose, to harass others, or
to reverse-engineer, decompile, or interfere with the app or infrastructure.
5. AI Coach — additional terms
The AI Coach feature (when enabled) sends an anonymised digest of your recent training data to Anthropic, PBC's API via a proxy we operate. The AI-generated text is not coaching advice from a qualified human coach and may contain errors, omissions, or recommendations that are inappropriate for your individual situation.
Treat AI Coach output as a discussion prompt or a second opinion, never as a substitute for your own judgement or a qualified coach. We do not guarantee the accuracy, completeness, or fitness-for-purpose of any AI Coach response.
6. Subscriptions, payments, and refunds
Some features of the Service require a paid subscription managed through Apple's App Store ("Pro"). Pro is offered as a recurring monthly or annual subscription at the prices listed at purchase time.
- Billing and renewals are handled entirely by Apple per the App
Store's standard auto-renewable subscription terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Refunds are processed by Apple, not us. Submit refund requests
through Apple's reportaproblem.apple.com page.
- Cancellation is handled through iOS Settings → Apple ID →
Subscriptions, or directly from Profile → Manage subscription inside the app.
- Price changes, if any, are communicated by Apple per its
standard subscription-change policy.
6.1 EU consumer right of withdrawal (digital content)
Under the EU Consumer Rights Directive (Directive 2011/83/EU, as transposed into Irish law by the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013), EU consumers normally have a 14-day right of withdrawal when purchasing digital content and services.
By starting your Pro subscription you expressly request that the Pro features become available immediately upon purchase and you acknowledge that, once the Service is fully performed (i.e. you have been granted access to the Pro features), the 14-day right of withdrawal no longer applies under Article 16(m) of the Directive.
This does not affect Apple's standard refund flow, which you can use at any time at <https://reportaproblem.apple.com> independently of this clause, nor your statutory rights under Irish or EU consumer-protection law.
7. Intellectual property
All app code, exercise descriptions, programme structures, AI Coach prompts, branding, and other content are the intellectual property of the operator (Can Ayan) or its licensors and are protected by Irish and international copyright law. You receive a personal, revocable, non-transferable, non-exclusive licence to use the Service for your own training. You may not redistribute, sublicense, sell, or use the content commercially.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non- infringement, accuracy, completeness, timeliness, or uninterrupted or error-free operation. To the maximum extent permitted by Irish and EU law, we disclaim all such warranties.
9. Limitation of liability
To the fullest extent permitted by applicable law (Irish and EU consumer-protection law preserves your statutory rights, which we do not exclude):
- We are not liable for any indirect, incidental, consequential,
special, exemplary, or punitive damages, including but not limited to personal injury, lost profits, lost data, business interruption, or any other intangible loss, arising out of or in connection with your use or inability to use the Service.
- We are not liable for any injury (including serious injury) you
may sustain while performing exercises suggested by the Service or acting on AI Coach output.
- Our aggregate liability for any direct damages, regardless of the
cause, is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) €20.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Irish or EU law, including liability for fraud, gross negligence, or wilful misconduct.
10. Indemnification
You agree to indemnify and hold harmless the operator (Can Ayan), its contractors, and its service providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) any injury or damage you cause to yourself or any third party while using the Service.
11. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice, including for violation of these Terms. You may stop using the Service and delete your data at any time via Profile → Manage data → Delete account.
Provisions which by their nature should survive termination (including disclaimers, limitations of liability, indemnification, intellectual property, and dispute resolution) will survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted at this URL with an updated "Last updated" date. Continued use of the Service after a change constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of Ireland, excluding its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms will be resolved in the courts of Ireland, except where mandatory consumer-protection law assigns jurisdiction to your country of residence within the EU.
EU consumers may also access the European Commission's Online Dispute Resolution platform at <https://ec.europa.eu/consumers/odr>.

Plain-language summary (not part of the Terms): Hybrid Athlete tells you what workouts to do. It does not replace your doctor, a real coach, or your own common sense. Exercise is risky — if you have any medical concern, talk to a healthcare professional first. If you hurt yourself, that's not on us. If our software malfunctions, our refund is limited to roughly what you paid us in the last year. By using the app you agree to all of the above.
