Terms of Service — WishMeLuck

These Terms govern your use of WishMeLuck. By creating a profile or using the app you agree to them, and to Apple's standard Licensed Application End User License Agreement, which governs your licence to the software. If you do not agree, do not use the service.

1. Who can use WishMeLuck

You must be at least 13 years old. If the law where you live sets a higher age of digital consent, that age applies, and you may need a parent or guardian's permission. Accounts operated by bots or AI posing as people are prohibited — the whole point of WishMeLuck is that a real person moved for you. (The simulated companions that ship inside the app are clearly disclosed and are not user accounts.)

2. Data protection and privacy

How we handle your information is described in the Privacy Policy. It forms part of these Terms.

3. Your content

You create asks, drawings, handwritten notes, photographs, and voice recordings ("Content"). You own your Content.

  • Circle Content (shared with your circle): you grant us only the limited licence needed to store, transmit, and display it to the people you shared it with. Nothing more.
  • Letters (sent to one person): the same limited licence, narrowed to delivering the letter to its recipient. A letter is private in the sense that only its recipient is shown it — it is not end-to-end encrypted, and a reported letter can be reviewed for safety like anything else.
  • Your Big Wish: while sealed it never leaves your device and no licence exists over it. If and when you mark it fulfilled, you are choosing to reveal it, and the limited Circle Content licence above applies from that moment — to the people who had already acted for you, and to nobody else.
  • Private Book Content: never leaves your device; no licence is granted or needed.
  • If we later add public sharing surfaces, content you choose to share publicly will carry a worldwide, non-exclusive, royalty-free licence for us to host, reproduce, and display it in connection with operating the service — and we will say so clearly in the app before you share.

You are responsible for your Content. Only photograph what you have the right to photograph; only sign your own name.

4. Rules of the wall

Be authentic. Be kind. You move for people here, or you don't — there is no room in this service for content that is:

  • harassment, bullying, threats, or hate speech of any kind;
  • sexual content involving minors — zero tolerance, immediate permanent ban, reported to authorities;
  • nudity or sexually explicit material;
  • promotion of self-harm, suicide, or eating disorders;
  • violent, gory, or illegal content, or content that infringes someone's intellectual property or privacy;
  • spam, scams, or impersonation.

5. Moderation, reporting, and enforcement

  • Report-first design: anything reported by a circle member — an ask, an act, a celebration, or a letter — is hidden from everyone immediately, then reviewed. Review can restore it or remove it permanently.
  • Blocking: you can block any person; their content stops appearing for you at once.
  • Strikes: violations earn strikes. Three strikes within twelve months means a 30-day suspension per strike thereafter. Severe violations (child safety, sexual exploitation, credible threats) skip the ladder: immediate and permanent termination.
  • Filters: text and images pass automated on-device checks before entering a circle; refusals are not appealable in-app but you may contact us.

To report content: long-press it in the app (letters are reportable from the thread), or email info@kalibrefin.com. To report intellectual-property infringement, include the work, the location of the infringing content, and your contact details.

6. Termination

You can delete the app and walk away at any time; local data goes with it. We may suspend or terminate accounts for violations as described above. Accounts inactive for 2 years may be deleted after notice. On termination your circle content is removed from our systems within a reasonable period, subject to legal retention duties.

7. Licence to use the service

We grant you a personal, non-exclusive, non-transferable, revocable licence to use WishMeLuck for its intended purpose. Don't reverse-engineer, scrape, resell, or interfere with the service.

8. Purchases

WishMeLuck is currently free with no in-app purchases. If purchases arrive, they will be governed by Apple's payment terms and described clearly before you pay.

9. Limitation of liability

WishMeLuck is a ritual of care between friends, not a promise of outcomes; nothing in it is medical, financial, or legal advice. The service is provided "as is". To the maximum extent permitted by law, Samosfi Studio is not liable for indirect or consequential damages arising from use of the service. Nothing in these Terms limits liability that cannot lawfully be limited.

10. Applicable law and jurisdiction

These Terms are governed by the laws of Ireland. Disputes belong to the courts of Ireland, unless mandatory consumer law where you live provides otherwise.

11. General

If a clause is found invalid, the rest stand. We may update these Terms; material changes are announced in the app before they take effect, and continued use is acceptance.
